1. INTRODUCTION TO THESE TERMS OF USE ("Terms")

1.1 Important Notice We kindly ask that you review these Terms, together with our Privacy Policy (collectively, "Agreement"), as they govern your access to and use of this website, jobscanner.pro (this "Site") and all products and services available thereon.

 

1.2 These terms are legally binding. We kindly ask that you read these terms carefully before using our site. By using the site, you are indicating that you have read and accepted these terms. 1.3 About Our Services Our Site is designed to serve as a convenient hub for job seekers, aggregating job vacancies from various online sources and offering a centralized platform for searching and exploring these opportunities. It could be described as a search engine for job vacancies. We would like to clarify that we do not participate in the hiring or selection processes and are not a recruitment firm. Our role is simply to index available vacancies published by others. When you choose to apply for a vacancy, you will be redirected to the original job post on the third-party site or service, either directly or through our easy apply service. The Site also offers the option for job seekers to upload a CV. In this policy, we collectively refer to our activities, products, and features on the site and the site itself as the "Services."

 

1.4 About us. By entering into this Agreement, you are entering into an agreement with Job Evolution Services Kft. Job Evolution Services Kft. is a Hungarian company (VAT: HU32201963) with its registered address at Hungary, 1173 Budapest, Pesti ut 17. For the sake of clarity, we would like to refer to Job Evolution Services Kft. as "we," "us," or "our" in this document.

 

 

1.5 You, as a party to this agreement. When we refer to "you," we are speaking on behalf of all individuals who access the features of our Site, including visitors, professional recruiters, and hiring managers. Specifically, the term "jobseeker" refers to you, if you are an individual searching our site for job vacancies or have created an account with us for the purposes of learning about career development and job opportunities/applying for positions.

 

If you are a person acting in a business capacity who is using our Site or Services for the purposes of establishing a business relationship with us, or Jobseekers, including recruitment of Jobseekers, then you are what we refer to as a "Recruiter." If you are a business professional representing an entity or organization in this agreement, we kindly request that you confirm you have been authorized to agree to the provided Terms and to form a binding contract with us. In such cases, every reference to "you" and "your" in the Terms, with the exception of this paragraph, will concern that entity or organization which you have entered into this agreement on behalf of.

 

If you are not a jobseeker or recruiter but are any other person who is accessing or otherwise making use of our services, including this site, we kindly ask that you refer to yourself as a "site visitor."

 

1.6 Children We kindly ask that the Services not be used by anyone under the age of 18. We also ask that you confirm that you are at least 18 years of age or the appropriate age of legal capacity in the country in which you reside before using this Site and any Services.

 

1.7 Changes We reserve the right to amend these terms and any document referenced at any time, should the need arise. We kindly request that you check this page and its linked pages from time to time to take notice of any changes we make, as they will be binding on you. Please note that some of the provisions contained in these Terms of Use may also be superseded by provisions or notices published elsewhere on our site. We kindly request that you accept the Terms that apply to you by continuing to use our Services.

 

1.8 Additional terms relevant to recruiters and future business partners. Should your business enter into an agreement with us to provide additional services in a commercial collaboration, you will be subject to additional terms of agreement to be determined at the relevant time.

 

2. THIRD PARTY CONTENT

 

2.1 User Content Users of our Services, including but not limited to job seekers, may upload content to the Services, such as resumes or CVs or other content. We refer to this user-generated content as "user content."

 

2.2 Third Party Content In addition to the content uploaded by users, the services may also feature content created or uploaded by third parties, including job vacancies. It is worth noting that, as an aggregator, as outlined in section 1.3, we do not have direct control over the content in question, which we have termed "third-party content."

 

2.3 Due care. We kindly ask that you exercise due care when using the Services. We do not conduct any criminal or other identity checks on any visitors or Services users. Similarly, we do not involve ourselves in any disputes between you and any other user, unless such dispute involves us being required by law or court order to take steps to remove content, for example, in an intellectual property dispute. We kindly ask that you refrain from any actions or statements on the site that could be perceived as inappropriate or unacceptable. We also wish to clarify that we do not have the capacity to monitor the content of the site on a regular basis. However, should you post something in any area of the Services which allows users to post content, or in any communications with us, and we receive a complaint from a user or third party, or have our own concerns with such content, we may, at our discretion, remove it if we believe it is in violation of any law or breaches these Terms of Use, or our Privacy Policy.

 

2.4 Disclaimer of liability. We kindly ask that you acknowledge that we assume no responsibility for the content, privacy policies, or practices of any user content or third-party content. Furthermore, we would like to clarify that our site does not have the capacity to censor or edit the content of any third-party website. We kindly ask that you acknowledge that we will not be liable for any and all claims, demands, and damages of any kind and nature arising out of or in any way connected to any and all potential liabilities arising from the use of any third-party network or content. We kindly request that you ensure that any employer or recruiter you apply to is properly licensed, certified, insured, and bonded, to the extent that you require, should you apply for a role that is indexed on our site.

 

3. We hope you enjoy our services. However, we reserve the right to alter, suspend, or discontinue the services at any time. We are committed to continuously developing new and enhanced services and functionalities. We reserve the right to offer you additional services or make revisions to existing services at our discretion, with or without notice. These Terms will apply to all such services provided at the relevant time. We reserve the right to alter, modify, suspend, or discontinue the Site, Services, or any part thereof at any time.

 

3.2 No guarantee can be provided. Please note that nothing in these Terms or within any content of the Services, or in any communication with us, should be construed as a guarantee or promise of employment of any kind. We would like to clarify that we are not a recruiter and that we do not have any influence on the decision-making process of recruiters. We do not wish to appear to endorse any specific recruiters or employers. Our services are designed to provide search functionality only.

 

3.3 Right to refuse. We reserve the right to refuse access, terminate your use of our services, or disable your account on our site at any time, for any reason or no reason, without notice, explanation, or liability of any kind.

 

3.4 Errors We kindly ask that you note the possibility of typographical errors or other inaccuracies on the Site. In making decisions about your use of the Services, we recommend that you not rely on any statement made on the Site, Services, or in communications.

 

4. We kindly ask that you use the services in accordance with the following terms:

4.1 Permitted Purpose We kindly ask that you use the Services for personal, consumer, or your own internal business purposes (please note that this does not include commercial purposes, such as reselling or otherwise making a profit from any third party by misrepresenting the Services as your own, or by selling access to the Services to any third party).

 

4.2 Unauthorized use We kindly ask that you refrain from using this Site and the Services for any purpose other than the Permitted Purpose. Any other use of this Website is prohibited and, therefore, constitutes unauthorized use. We kindly request your understanding and acceptance that no relationship is established between us and you of any kind other than as laid out in this Agreement. Specifically, we would like to clarify that no relationship of employee, employer, contractor, or consultant is being established.

 

5.2 You further warrant and represent that you will not use the Site or the Services in any way (nor seek to transmit, share, broadcast or otherwise engage in any activity on or through the Site or Services), which, in our sole judgment, may be considered to be using the Services for any non-Permitted Purpose (e.g. We kindly ask that you refrain from using this Site or its data or contents on another site or through a networked computer environment for commercial purposes. Similarly, we request that you do not modify, publicly display, publicly perform, reproduce, or distribute any part of this Site or the Services in whole or in part.

 

We kindly ask that you refrain from stalking, harassing, or harming another individual, or collecting, using, or storing personal data about other users without their consent. This includes, but is not limited to, the use of scripts, bots, web crawlers, or scraping of any kind.

 

To interfere or disrupt networks connected to the Services or with the proper functioning of the Services, including, without limitation, submitting a virus to the Services, overloading, flooding, spamming, mail bombing or crashing or otherwise attempting to deny service to the Site, Services or the server of any user.

To gain unauthorized access to any portion of this Site, or Services, or any other accounts, computer systems, or networks connected to the Services, whether through hacking, password mining, or any other means, or to cause technical harm by any means, including without limitation computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data, or other malicious software or harmful data.

We kindly ask that you refrain from any activity that may breach the rights of a third party. This includes, but is not limited to, intellectual property laws and the rights afforded to rights owners, such as the use of copyrighted content (such as music, videos, photographs, images, etc.). We also ask that you do not use trademarks, patents, trade secrets, or other proprietary information without first obtaining consent from the rights owner and providing evidence of such consent to us.

 

We kindly ask that you refrain from advertising or soliciting any person to buy or sell any products or services. This includes, but is not limited to, uploading, posting, emailing, transmitting, or otherwise making available any unsolicited or unauthorized advertising, promotional materials, affiliate marketing codes, link referral codes, or any other form of commercial solicitation.

 

In addition, we kindly ask that you refrain from engaging in any other activities that we may deem to be unacceptable or potentially damaging to any third party, other user of the Services, us, our affiliates, the Site, or the Services in any way. This includes causing any physical or reputational harm, or any other intangible harm.

 

We would be happy to submit applications on your behalf to the external job vacancies listed below, in accordance with our Privacy Policy. If you would like us to apply to specific companies on your behalf, we kindly ask that you check the boxes next to the relevant companies. You have the option to select individual companies, agree to all listed vacancies, or decline this option entirely. If you do not select any companies, no application will be submitted on your behalf to any external vacancies.

 

In certain instances, the Company may share users' personal data with third-party employers, recruiters, or other entities that are not registered on the Site but operate outside of it. It is possible that these third parties may have job vacancies that are similar or relevant to the user's interests. We would like to reassure you that any sharing of personal data is done strictly for the purpose of facilitating employment opportunities for the user.

In cases where the user has provided explicit and informed consent, the Company reserves the right to apply to similar or relevant job vacancies on behalf of the user, should this be of interest to them. We would like to reassure you that your personal data will only be shared with third-party employers, recruiters, or other entities to whom you have explicitly consented to the transfer. We kindly request your consent to enable us to apply for other similar vacancies on your behalf. Once you have completed the application form for a specific vacancy on the site, you will be presented with this additional option. The user has the option to manually select the specific companies with whom he or she is comfortable sharing his or her personal data for the purpose of applying for a job. If the user would like to indicate their interest in a particular company, they can do so by checking the appropriate box. The user has the option to select as many or as few companies as they would like. By selecting the relevant third parties, the user kindly gives permission to the Company to submit his or her personal data to third-party employers, recruiters, or other entities with vacancies that may be of interest or align with the user's qualifications and interests. 

The Company will only share the user's personal data with third parties that have been explicitly selected by the user. In the event that no companies are selected, we would like to reassure you that your personal data will not be shared with any third-party employers, recruiters, or other entities beyond the initial application.

The personal data that may be shared with selected third-party employers, recruiters, or other entities will be limited to the data provided by the user when applying to a vacancy on the site. The Company will take care to ensure that only the relevant personal data necessary for the recruitment process is shared with third parties. This will be in line with the information that the user has kindly provided during their application on the Site.

We would like to kindly remind you that any third-party employers, recruiters, or other entities to whom the Company may share your personal data are responsible for processing it solely for recruitment and employment purposes. It is expected that these parties will comply with applicable data protection laws and implement appropriate security measures to protect the personal data they receive.

By providing consent for the sharing of their personal data, users acknowledge and agree that the respective third parties will use this personal data in accordance with their own terms and privacy policies.

6. PAYMENTS

 

6.1 We are pleased to offer our services free of charge to jobseekers at this time. Should we introduce any paid features, products, or services, we will be sure to inform you and update these terms to reflect any changes to our billing model.

 

6.2 In addition to clause 1.8, any payments for business partners will be outlined in the supplementary commercial agreement between us and you, acting in a business partner capacity.

 

7. CLASS ACTION WAIVER

 

We kindly request your agreement not to participate in any class action. Furthermore, we ask that you refrain from initiating any claim relating to a dispute unless you are acting solely as an individual in an individual action under any jurisdiction. We also ask that you respect the fact that class action procedures or rules will not apply to the arbitration or any other dispute process. In the event of a dispute, we kindly ask that you refrain from joining or consolidating claims by or against other affiliates or persons, or arbitrating any claim as a representative or class action or in a private attorney general capacity. We kindly request your understanding that by accepting these terms, you are relinquishing your rights to participate in a class action or representative action with respect to any such claim.

 

8. INTELLECTUAL PROPERTY RIGHTS

 

8.1 We kindly request your acknowledgment and agreement that the copyrights, trademarks, and other intellectual property rights, including registered and unregistered intellectual property rights of any kind in any territory, across the Services and the content provided as part of the Services, belong to us or are used under exclusive license by us. We kindly request that you note that no rights in respect of the Services or the content provided as part of the Services are granted to you other than those expressly set out in these terms of use. Any rights not expressly granted herein are respectfully reserved. We kindly ask that you refrain from reproducing, distributing, modifying, retransmitting, or publishing any copyrighted material without the express written consent of the copyright owner or license, unless otherwise required or limited by applicable law.

 

8.2 By submitting any User Content or Third Party Content (as previously defined in these Terms) to our Site, you are certifying that you are the exclusive author and owner of that content (and that our use will not infringe or violate the rights of any third party, including privacy rights, publicity rights, intellectual property rights, contract rights, or any other rights). 13.4 This document represents the entire agreement between us. We kindly ask that you read through these Terms, as well as any other documents that refer to them, such as our Privacy Policy. These documents together form a legally binding contract that governs the relationship between us and you. We kindly request your attention to the fact that this Agreement supersedes any conditions that may have been agreed to in the past, even if not directly withdrawn or amended. It constitutes the entirety of the rights and obligations in place between us and you. In accordance with clause 1.8, we would like to propose that any business-to-business relationships be additionally governed by the terms of any supplemental B2B agreement that we may enter into with your company.

 

13.5 Governing Law and Jurisdiction. We kindly request your understanding that these Terms will be governed by the laws of England and Wales. We kindly request that any disputes relating to these Terms or the Services to which they relate be heard exclusively in the courts located in England, UK.

 

13.6 Language We kindly request your understanding that these Terms are written in the English language. Therefore, we ask that any proceedings relating to these documents and any related dispute be conducted in English. Should we make these documents available in any other language, we would ask that the terms in the English language version prevail.
